1. Acceptance of Terms

By using Mann Trans Inc's transportation services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

These terms apply to all transportation services provided by Mann Trans Inc, including but not limited to refrigerated transportation, dry van services, ocean freight, air freight, and warehousing services.

2. Service Description

Mann Trans Inc provides temperature-controlled and general freight transportation services, including:

  • Refrigerated transportation for fresh produce, meat, and perishable goods
  • Dry van transportation for general cargo
  • Ocean freight and air freight services
  • Heavy haul and specialized transportation
  • Warehousing and distribution services
  • Cross-docking and logistics solutions

3. Booking and Quotations

Quotations: All quotations are valid for 30 days from the date of issue unless otherwise specified. Prices are subject to change based on fuel costs, market conditions, and other factors.

Booking Confirmation: Services are confirmed only upon receipt of a signed service agreement or written confirmation. Verbal agreements must be followed by written confirmation.

Capacity: We reserve the right to refuse service if we do not have available capacity or if the cargo does not meet our safety and handling requirements.

4. Cargo Requirements and Restrictions

Prohibited Items: The following items are prohibited and will not be transported:

  • Hazardous materials without proper documentation
  • Illegal substances or contraband
  • Perishable goods without proper temperature requirements
  • Items that may damage other cargo or equipment
  • Live animals (except as specifically agreed)

Documentation: All cargo must be properly documented, labeled, and packaged according to applicable regulations and our requirements.

5. Temperature-Controlled Services

For refrigerated transportation services:

  • Temperature ranges must be specified in advance and confirmed in writing
  • We will maintain temperatures within ±2°F of the specified range
  • Temperature monitoring data is available upon request
  • Customer is responsible for pre-cooling cargo to specified temperature before pickup
  • Additional charges may apply for extended temperature monitoring or special requirements

6. Payment Terms

Payment Methods: We accept payment by check, wire transfer, and approved credit terms.

Payment Terms: Net 30 days from invoice date for approved credit customers. Cash on delivery (COD) or prepayment may be required for new customers or high-risk shipments.

Late Payment: Late payments are subject to a 1.5% monthly service charge. We reserve the right to suspend services for accounts with outstanding balances over 60 days.

Additional Charges: Additional charges may apply for detention, layover, fuel surcharges, and other services not included in the base rate.

7. Liability and Insurance

Limitation of Liability: Our liability for loss or damage to cargo is limited to $0.50 per pound of cargo weight, not to exceed $50,000 per shipment, unless higher value is declared and additional charges are paid.

Exclusions: We are not liable for loss or damage caused by:

  • Acts of God, natural disasters, or weather conditions
  • War, terrorism, or civil unrest
  • Government action or regulation
  • Improper packaging or labeling by the customer
  • Inherent vice or nature of the cargo
  • Delay in delivery due to circumstances beyond our control

Insurance: We maintain cargo insurance as required by law. Additional insurance coverage is available at customer's expense.

8. Delivery and Pickup

Delivery Times: Estimated delivery times are provided in good faith but are not guaranteed. We will make reasonable efforts to meet scheduled delivery times.

Access Requirements: Customer is responsible for ensuring adequate access for our equipment at pickup and delivery locations.

Storage: Free storage time is limited to 24 hours at origin and destination. Additional storage charges apply after the free period.

Delivery Confirmation: Delivery is considered complete when cargo is unloaded at the destination address or when a delivery receipt is signed.

9. Claims and Disputes

Claims Process: All claims for loss or damage must be filed in writing within 15 days of delivery. Claims must include:

  • Original bill of lading or shipping document
  • Detailed description of the loss or damage
  • Photographs of damaged cargo (if applicable)
  • Proof of value and extent of loss

Dispute Resolution: Any disputes arising from these terms or our services will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

10. Force Majeure

We shall not be liable for any delay or failure to perform due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government action, labor disputes, or equipment failure.

11. Compliance and Regulations

All services are provided in compliance with applicable federal, state, and local regulations, including but not limited to Department of Transportation (DOT) regulations, Food and Drug Administration (FDA) requirements, and environmental regulations.

Customer is responsible for ensuring cargo complies with all applicable regulations and for providing necessary documentation and permits.

12. Modification of Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after changes constitutes acceptance of the modified terms.
